Who you're contracting with
StoreSpark AI ("StoreSpark AI", "we", "us") is operated by Pamela Akello Oduori, a sole trader. By creating an account or using the service you agree to these Terms. If you're using StoreSpark AI on behalf of an organization, you confirm you have authority to bind it.
The service and what you get
StoreSpark AI is a web-based marketing content assistant for ecommerce sellers. You enter a product description (or import one from a Shopify product URL) and the service generates marketing copy from it. The following features are live and available immediately after purchase: product descriptions, UGC video scripts with shot lists, social captions, short-form video hooks, email campaign copy, calls to action, hashtag sets, AI image prompts, a content calendar, saved content with favourites, and per-item editing, regeneration and rewriting. Free accounts include a limited number of generations per month. A single one-time payment of $9 USD unlocks full access to the features listed above for your account.
Acceptable use
Use StoreSpark AI only for content about products you legally sell or represent. You must not: (a) use the service unlawfully or for fraud or spam; (b) infringe anyone's intellectual property; (c) probe, scrape, reverse engineer or interfere with the security of the service; or (d) resell, redistribute or sublicense access to the service itself.
Prohibited AI use
StoreSpark AI uses generative AI models. You must not use the service, or any output from it, to create or distribute: illegal content; sexual content, or any content involving minors; deepfakes, voice clones, or content that impersonates a real person, brand or public figure without their permission; hate speech, harassment, or content inciting violence or self-harm; malware, phishing, or other malicious code; disinformation or deceptive claims about a product's effects, results or earnings; content promoting weapons, illegal drugs or other prohibited goods; or regulated medical, legal, financial or investment advice presented as professional guidance. You must also not attempt to jailbreak, prompt-inject or otherwise circumvent the model safeguards or usage limits of the service.
Content moderation
We may filter or refuse to produce outputs, remove or restrict content stored in your account, and suspend or terminate accounts where we reasonably believe this section or the section above has been breached. We may do this without prior notice where there is a legal, safety or security risk.
Intellectual property complaints
If you believe content generated or stored using StoreSpark AI infringes your intellectual property, email support@storespark.app with the material in question, your rights in it, and your contact details. We review complaints promptly, remove or restrict infringing material where a complaint is valid, and terminate the accounts of repeat infringers.
Your content and AI outputs
You keep ownership of the product information you submit and of the content you generate. You grant us a limited licence to host and process that content only to provide the service. You are responsible for your prompts, for reviewing outputs before publishing, and for making sure you have the rights to any input content. AI outputs can be inaccurate — check them before use and don't rely on them as professional advice.
Our IP
StoreSpark AI (including the software, prompts, branding and documentation) is owned by us. We grant you a limited, non-exclusive, non-transferable right to use the service under your chosen plan.
Payments
StoreSpark AI Founding Access is a one-time payment of $9 USD. It is not a subscription, it does not auto-renew, and no further charges are made. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by the Paddle Checkout Buyer Terms. We offer a 30-day money-back guarantee — see our refund policy.
Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You can stop using the service at any time.
Warranties and liability
The service is provided "as is" without warranties of any kind to the fullest extent permitted by law, including implied warranties of merchantability or fitness for a particular purpose. To the maximum extent permitted by law, our aggregate liability is capped at the fees you paid us in the 12 months before the claim, and we are not liable for indirect or consequential losses (including lost profits, data or goodwill). Nothing in these Terms excludes liability that cannot be excluded by law.
Governing law
These Terms are governed by the laws of the operator's country of residence, and disputes will be handled by the competent courts there, unless mandatory local consumer law says otherwise.
